CBDA Insider’s Update: Week of August 3, 2020

by | August 3, 2020

The CBD Association is working hard for you both in the U.S. and internationally. Here are some recent developments:

Nevada Fines Cannabis Company $1.2 Million for Selling Untested Products and Destroying Evidence

Nevada Company, CW Nevada, was fined $1.2 Million by the Nevada Cannabis Compliance Board for selling cannabis off-books, untested products, and destroying evidence.

In 2019, CW sold 1,793 products in less than three months that were not laboratory-tested along with another unregistered 4,100 plants. Regulators have destroyed all of the unregistered products.

In addition, the company was accused of illegally moving products, failing to maintain video surveillance and inaccuracies in their reporting to the state’s seed-to-sale tracking system.

Regulators revoked some of CW’s licenses and the remaining active licenses will be sold within the next six months to help pay the company’s back taxes of $1.5 Million.

EU Pulls a Shocking Backpedal and Issues New Opinion on CBD to be Categorized as a Narcotic

According to Hemp Industry Daily, the executive branch of the European Union is changing its stance on how EU countries should vote on the World Health Organization’s cannabis scheduling changes in December.

If the Commission’s new stance is adopted, hemp-derived CBD would no longer be considered food and could be banned from the EU market.

The most surprising part of this change in direction is the timing – the EU has allowed hemp-derived CBD to fall under the novel foods status for the past two years.

FDA Expands the Use of Epidiolex

The U.S. Food and Drug Administration (FDA) expanded the use of CBD drug Epidiolex. The drug was previously approved to treat seizures associated with two forms of severe epilepsy. This expansion now allows for the use of Epidiolex to treat seizures associated with tuberous sclerosis complex.

Texas Smokable Hemp Plan Now in Effect

As of yesterday, smokable hemp is no longer illegal for sale and distribution in the state of Texas. Part of Texas HB 1325, the smokable hemp ban went into effect despite the objections of thousands of hemp industry members, including the Texas Hemp Industries Association.

The cultivation, storage, and processing of hemp for other products is not prohibited. Nothing in the new law prevents the possession of or online purchase of smokable hemp products.
